Tod Listens - Terms of Use

1. Who We Are

Greenan AI LLC operates under the DBA (doing business as) name Tod Listens, a unique voice-based conversational AI service. Tod is designed to support self-discovery, encourage meaningful conversations, and provide thoughtful, active listening in a private and app-free format.

2. Registration and Access

• Minimum Age: You must be at least 18 years old to use Tod Listens. If under 18, permission from a parent or guardian is required.
• Account Information: By creating an account, you agree to provide accurate information and secure your credentials.

3. Using Tod Listens

• Permitted Use: You may use Tod Listens to engage in meaningful conversations.
• Prohibited Activities: Any misuse, such as circumventing security, using Tod’s responses for competitive purposes, or unauthorized data extraction, is prohibited.

4. Content

• Your Content: Your verbal input is termed "Input," and Tod’s responses are "Output." You are responsible for the nature of your Input.
• Ownership: You retain rights to your Input, and we assign any rights in Tod’s Output to you.
• Accuracy: Tod’s responses are AI-generated and should not be solely relied upon for factual accuracy.

5. Personal and Sensitive Conversations

Guidance, Not Therapy: Tod Listens provides conversational support and is not a replacement for professional mental health services. If Tod detects that you may benefit from professional support, Tod will recommend relevant resources, such as the 988 Suicide & Crisis Lifeline.

6. Intellectual Property Rights

Greenan AI LLC retains all rights to Tod Listens. You may not use our name, logo, or related materials without permission.

7. Paid Services

• Billing: Accurate billing information is required for subscriptions, with fees automatically charged unless canceled.
• Subscription Changes: We may adjust fees and will provide 30 days' notice for increases, allowing you to cancel if needed.

8. Termination and Suspension

• Ending Your Use: You may stop using Tod Listens anytime. We reserve the right to suspend accounts for violations or inactivity.
• Appeals: Appeals for suspended accounts can be made by contacting Support.

9. Dispute Resolution

All disputes will be resolved through binding arbitration, except as prohibited by law. Class actions are not permitted.

10. Disclaimer of Warranties

TOD LISTENS IS PROVIDED "AS IS." Greenan AI LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.

11. Limitation of Liability

Greenan AI LLC will not be liable for indirect or consequential damages. Liability is limited to the amount paid for services in the last 12 months.

12. Indemnification

If you are a business, you agree to indemnify Greenan AI LLC from claims arising from your use of Tod Listens.

13. Changes to These Terms

Greenan AI LLC may update these Terms, with material changes notified 30 days in advance. Continued use of Tod Listens constitutes acceptance of revised Terms.
